We all know one of the top priorities of President Trump will be replacing Scalia, and I look for him to put forward a nominee within the first 60 days and would hope its someone with the same judicial philosophy as Scalia. After that, I could see Thomas stepping down, and possibly Kennedy or Briar. I would say Trump will have a minimum of 2 picks prior to the 2020 election, and possibly 3. Now if he would win in 2020, he could end up with 4 or 5 total which would be pretty amazing. He also needs to drain the swamp of all the activist liberal judges in the lower courts that Obama has put forward the last 8 years.

You saw who he's been putting in place for his cabinet positions right? I wouldn't be so sure about his nominating someone like Scalia for SCOTUS. His whole "drain the swamp" bs has gone about as far as it's going to. It was all talk and soundbites to reel in voters.

 

Also, I can't speak for Kennedy, but I have reason to think (very good connections) that Breyer won't leave - especially not now.

If Trump is smart, he's going to put in a mix of his loyal supporters that the base will approve of, along with some establishment figures. He has to transition from candidate mode to governing mode, and by extending a hand he's going to help himself deliver more results for the American people. One area he will not be able to screw up on is the SC pick. McConnell, who is deemed to be an establishment guide, held firm and appeased the base by not allowing an Obama pick to proceed.

 

You may be right that Briar and Ginsburg won't leave, but they are old and may not have a choice.

Depends which lens you are looking through...let's not pretend that the Dems did not take this same position in 1992 and are on tape stating that an election only months away should decide who gets to make the SC picks.

I think Trump should proceed with Merrick Garland.

 

The American people voted, and they decided that they do not care about the obstruction of SCOTUS nominations. I'm fearful of what this means. It will be hard to begrudge any party for learning the lessons of this. But SCOTUS is an important institution.
