Maurice Washington Faces Charges

[Washington] faces criminal charges under California’s relatively new “revenge porn” law in connection to a video of a 15-year-old teen allegedly being sexually assaulted... Washington did not record the video and is not part of the alleged assault. But Washington is accused of keeping the video on his phone and sending it to the victim last March, along with the message, “Remember this hoe [sic].” Because the victim was 15 when the video was recorded, he’s also being charged with distribution of child pornography, a felony.

I don't know that we can jump to the conclusion that Washington is going to be kicked off the team. He may not be charged with a felony.

 

Some pertinent parts of the story:

Washington’s text message, according to the search warrant affidavit, was actually intercepted by Taylor’s step-mother, who monitors Taylor’s electronic messages through an iPad tablet. She told Taylor not to watch the video, and immediately reported the incident to the Santa Clara County Sheriff’s Department.

 

An investigator on the case said the Sheriff’s Department has been unable to interview Washington during the months-long investigation after making requests through the University of Nebraska’s Athletic Department, as well as Washington’s former attorney, Jon Bruning, who is the former Attorney General of Nebraska.

 

The investigator said Bruning questioned whether charges would actually be filed against his client when contacted last fall by the Sheriff’s Department.

 

“The general air was, ‘Is this really as big of a deal as you’re making it?’” the investigator said. “I explained to him that we do take these cases very seriously. Cases like this can have severe consequences, especially for the victims, throughout their entire lives, and we were investigating wholeheartedly because of that fact.”

 

Bruning, reached Friday by NBC Bay Area, declined to comment on the case.

 

Washington, currently in Nebraska, is not yet in custody.

 

Taylor said she is still considering whether or not to press sexual assault charges against her two former classmates in connection to the video.

 

“At the time I was not ready to deal with it,” she said. “I think now I am.”

I don't know what they knew then, but at that time it was an 'allegation'.  At least that's what the article says.  Maybe that's why he was allowed to stay on.

Even if that happens, I hope he is kicked off the team. That's a horrific thing to say to an assault victim. I don't want that cancer in the locker room.

Since he's been charged, he needs to be suspended immediately pending the outcome of the trial.

It's not an assault until it's shown to be in court. To date, she hasn't pressed charges.

 

Let's be careful of the words we use here. These situations can be far worse or far less severe than they seem at first blush.  Let's wait until the second wave of news hits. We haven't heard from Washington yet.

 

There's plenty of time to kick the guy off the team. Let's be sure we need to before we convict him here.

Possibly not even probation. That kid was actually one of the ones in the video, that she accuses of rape, and he sent it to classmates. That is more egregious than sending it to just her out of apparent spite.

 

But this part isn't a good look:

And, the text sent to her was bad.  However, let's remember, he wasn't the one that was video taped having sex with her or video taping it.  He was not involved (as far as we know) until he received the video on his phone.

If I down load a naked picture of a 13 year old girl and text it to you, you aren't immediately guilty of child porn.

No, when he sent it on to her is when he was guilty.


If I text you that same picture, and you immediately delete it, you still aren't guilty of child porn....even though you didn't call the police.

Question....and it may not have a huge bearing on the outcome.  But, how old was he when this was happening?

I don't really know why we're arguing about when he became guilty, he clearly had the video for long enough to send it and that alone is bad enough. Obviously they'll wait until all of the details come out, but if it's true (and it seems like it is), he needs to be gone. He'll probably get a second chance somewhere, but it shouldn't be here.

I don't think there needs to be a legal penalty for there to be a team penalty.  He should not be on the team if Frost is true to his "high character" standards.
