So by your example, if there is a law against someone misgendering a person in California and you did that from the comfort of your home in Iowa, the charges would be in California.

so you can break a california law via social media from the comfort of your own home...impressive really. Just never visit cali and good to go

Since police had this video of alleged sexual assault why wasn’t one of the boys in the video charged with sexual assault instead of distributing pornography? How stupid would one be to have sex with someone, make a video of it and then share it with your friends if it was sexual assault?  I don’t pretend to know the psychology of someone that was raped but I’m sure the girl was aware that the video was being sent around so I would think that would be the time to let it be known that the video being shared was of her being sexually assaulted and not consensual.

It's not much different than making terroristic threats over the phone between Iowa & California. It's still a crime & you'd still be charged. The crime (I believe) is said to have occurred where the threat is heard, so you'd be subject to California laws. 

 

Again, maybe a lawyer could clarify that for us, but I'm reasonably certain the same principle applies.

Possibly because those facts haven't been cleared up to begin with, haven't gone to trial, or something of that nature. I'm not sure. I couldn't find answers to that very question in the original article in the OP of this thread.

Seriously stupid of Washington to send this message to her, though. Holy s***.

That was mentioned in the article. She did not report it as rape because the felt ashamed. She is still considering whether or not to press sexual assault charges to this day.

That part was there, yes.

But that doesn't mean that it couldn't still come about from a litigation standpoint of the two other guys.

One scenario I can think of here:

 

Mo dated said girl in the video. The video he has is what prompted them to break up and he kept it (for whatever reason). Maybe when videoed originally it was consensual, after it started being distributed the girl changed her mind that it wasn't. I dont know, but it happens all the time. She reaches out to him a couple years later because now she sees his success at NU. He's still heartbroke over the ordeal and responds with the video, essentially sticking it in her face. She then decides to turn him into police for revenge porn/child porn etc. as a get back at ya moment.

 

This scenario sounds more realistic to me. Doesnt make it much better. He's gonna have to learn he's in a pretty high profile place and people are gonna come at you. Need to learn some situation awareness. Could have just responded with a "wrong number" and left it at that. But now he has a serious problem on his hand.

So....for all the people who think this is a slam dunk case and he should be thrown off the team and his life irreparably damaged.

 

This alleged assault happened several years ago.

 

He sent the video in March of 2018 (11 months ago).

 

California officials knew about this long enough ago that Frost found out about it at least 4 months ago.

 

So....if it's a slam dunk that he is guilty of child porn or whatever, why isn't he arrested yet?  

 

I know someone who was arrested for child pornography.  No, the FBI didn't wait to gain permission to "interview him".

 

I'll wait till more information comes out.
