Maurice Washington Faces Charges

My post wasn't just directed at you.  It was directed also at people who want him kicked off now with what we know.  I'm interested in their opinions.

I'm not saying, in any way, that we need new laws for this situation...although, that is what our reactionary society tends to do.  I was simply saying that is the point of having laws, in general.

Why would legality determine the overall punishment Washington gets? Frost and the AD’s decision won’t be based on the legal consequences. He may not serve any time at all, so the biggest question is how Frost deals with him. He may kick him off the team if there is no legal punishment. He may keep him on the team even if he’s on probation. 

 

Some would argue the bar should be higher for Frost. Others would argue the law ignored context and he should go easy.

If it was someone on another team, we probably wouldn't analyze it as deeply as we are with this case. We might just see a misleading headline about a player being charged with child porn and jump to conclusions based on our biases and emotions. The same thing happened in this case, but since it is close to home we have dissected it for 10 pages, and there has been a variety of opinions.

 

I recall the Urban Meyer saga in August led to just as much discussion. Even though many of us wanted to see him burn because he dislike OSU and Meyer is a d-bag, many of us put a lot of thought into that situation and discussed many reasonable outcomes while it was still up in the air.

The same people who piled on opposing players who got caught tended to plead for much more understanding and less public scrutiny when the player was from Nebraska. Especially if that player was a starter. You know we'd be having a different conversation if Maurice Washington was a player who spurned Nebraska and signed with Iowa.

A couple reasons: 

 

1. It's the easiest method by which to proceed. If he's not convicted of anything, or similarly, pleads down and receives probation, Frost can easily say "we're going to keep him in the program, work with him and try and help him grow into a better person". (AKA, the "Lawrence"). If he receives something harsher than that, your hand is forced, and you remove him from the team. 

 

2. It ultimately takes morality out of the equation as much as possible. The questions about whether or not it's moral for an 18 year old and a 15 year old to have sex don't fit this situation, because it's not what Washington is accused of. If you base your judgement of whether or not Washington should remain in the program based on what he's actually accused of, it's very difficult for Frost to make the argument to keep him on the team, and you're remove Washington's right to due process. Now, I completely understand that this doesn't (and shouldn't) always happen, and in some situations (Kareem Hunt), it's impossible to wait for the legal system to diligently play out before you make a decision. However, in my opinion, it's real easy to say something to the extent of "we didn't know the depth of the situation last year, but we're going to let Maurice go through the legal system before making a decision on his standing with the Nebraska Football program" (I personally think he should be suspended from all team activities until further notice, but that's just me).

 

TL;DR: the legal process is the easiest method for Frost to make a decision, particularly if the ultimate goal is keeping Washington in Lincoln.

Yes, that was in the original article that accompanied the breaking story.  The judge has yet to act on the request for the warrant.
