Of course it would've been best to keep both, but in a midterm environment holding onto any chamber is practically unheard of. The president discusses the judges with Senators before nominating them to make sure they have the votes. Especially in times like these where they’re barely getting approved. They don’t just come up with a name and hope the Senators like the person. 1 Link to comment

The functional point is, if the Pres is Dem and the senate Rep, the President won’t really have a choice of who he wants to nominate. He’ll have to nominate a lesser evil that stands a chance. Technically he nominates them but effectively it is determined by the senate. You know this and we all know this. 1 Link to comment
