Fort Collins, CO -- A gas station in northern Colorado is being investigated for allegedly putting regular unleaded gas into premium pumps.
Amir Ali, the store operator, is accused of telling a fuel delivery driver to fill all the underground tanks with regular gas since the truck wasn't carrying any premium.
"It seems that they dumped a certain number of regular gallons of gasoline into the premium tank and a certain number of regular gallons into the mid-grade tank," said d!(k Piper with the Division of Oil and Public Safety.
He said the Ali denied doing anything wrong, but measurements taken with a tank stick and compared with the delivery papers showed a discrepancy.
"It's rare that we see intentional attempts at this sort of thing," Piper said.
The owners of the building said they had the premium tanks emptied and evicted the operator.
"The owners had nothing to do with any kind of fraud, if fraud was committed," said Duane Cole, the owner's attorney. "They have locked (the operator) out and they have taken control of the gas station."
Cole showed CBS4 a letter written to Ali a month ago after he allegedly tried to get another delivery driver to switch gas. It read: "We do not condone what you are doing. If you don't stop this immediately, we have no choice than to evict you from the store."
The state inspectors said Ali faces fines and will not punish the owner or the delivery truck driver. The fines could be up to $500 a day for each violation and the state's still looking into how many violations there actually were.
