Both get charged? The craziest thing about CA. Is that under age sex is sexual assault, whether or not it is consensual. Might as well lock up 75% of the kids in the state high schools.

You can’t say it was willingly. She might have done it under fear of something worse happening to herIt sounds like the video shows her willingly performing oral sex on a dude. If there's no physical force how can you prove it was assault? By taking her word?

I get it. But it’s nearly impossible to prove a verbal coercion if not recorded because there would be no signs of physical force. I’m not saying your not right- I’m just saying it’s nearly impossible to prove a conversation took place
Whether this was a sexual assault or not, if he saved the video and sent it to her to shame/hurt her, which appears to be the case, that should be enough for him to lose the privilege of playing football at the University of Nebraska.
All this is why when I go on a date, our first stop is a notary public. I have a legal document that states that any possible sexual encounters are consensual that we both sign before continuing on with the date. Always better safe than sorry.
This is also why I don't getmany second dates.
I've said multiple times there is almost 0 possibility she will be able to prove it was sexual assault, and I also find it unlikely it will ever even be a legal battle, and there are several reasons to doubt her claim.
But you can't know based on the video that it was willing. Please look up the legal definition of rape. I've posted the relevant parts earlier in the thread. It's like saying if someone looks like they like it, it can't be rape. That is false.

The only punishment I think is appropriate is for MW for keeping a video and sending it to the girl with the intent to shame her.I agree with you.
I agree with you too.... But you can't punish on those kind of assumptions.

I have had no opinions of what or if any punishments come to the two males in the video or to the girl if it’s found she isn’t being honest about a rape. All of that is irrelevant to me with regards to MW because he’s my RB on my team.

I mean... that sounds noble, but if you kicked off every athlete from every sport who said or did something to hurt their ex, half of Nebraska sports would be gone. And that's girls and guys sports.
This kind of "solution" is not a real-world idea. Kids do dumb things. You can't default to the nuclear option because someone offended someone else.
Man I just feel bad for kids these days having to grow up in a one strike you are out knee jerk lynch mob environment. This isn’t a rape/assault case though. One thing that seems certain is Mo sent the video.
Also, I don’t think race is important in this case. They had a prior relationship it seems and the video might have caused animosity.
It’s important to remember that they are teenagers.
