Any Lawyers out there?

Just looking for a little advice before making an initial call to a lawyer in town (Omaha area). My mother recently passed away and is free an clear of any 'normal' debts (house, car, credit cards). She was in the hospital for a couple weeks before passing, and we have a decent idea on what that bill will be. We know she has a will somewhere (still looking) but I would like to know if we will run into issues if we can't find it? There wont be any fighting over her estate as it's just me and my younger sister.

Any advice is appreciated.

 
Since I don't practice in Nebraska, I can't give you specifics, but every state has what's called intestate sucession statutes. That simply means how to handle an estate when the person passes without a will (or where a whill can't be found). Since the only close relatives are you and your sister, the entire estate will pass to both of you - and since you can both agree how it will be divided, there should be no problem at all. Of course, you'll most likely have to submit the estate to Probate (unless Nebraska has some statutory provisions that will allow transfers without Probate) - at least to non-personal items. That way, title can be transferred as to land, house, cars, etc.
