Here's why Football 101 has been on hiatus the last two years

That's what burns me so badly about this lawsuit. It's a charity, and someone takes it upon themselves to turn it.... well, I won't finish that thought. Let's just say I hope this is resolved in favor of the charity.
I'm inclined to agree with you. I'll just say this - if her story isn't as she alleges, shame on her for trying to steal from cancer research. If her story is as she alleges, shame Beck, absent medical staff, and the other defendants for not protecting the well-being of a fellow human.

You know I would think that if things really were kosher here that TO would probably have offered some kind of compensation if he knew about it. After all the athletic department probably has some kind of insurance for these things and they're budget itself could afford a payment for an incident like this. Didn't they have a good surplus this year even with construction? In all likelihood there probably will be a settlement at some point if her story checks out and the department will likely help foot the bill.

The reason this hit the courts is settlement procedures broke down. There's no way the BPF didn't try to settle with this woman. They just couldn't agree on a number.

LINCOLN -- The Bo Pelini Foundation and Husker offensive coordinator Tim Beck have been sued by a Lincoln woman who alleges she suffered a traumatic brain injury after being tackled during a women's football clinic at the Hawks Championship Training Center in June 2010.

The woman, Beverly J. Morgan, was 64 at the time of her injury, which she said occurred during a gauntlet drill during a "Football 101" clinic.

In her lawsuit, filed Tuesday in Lancaster County District Court, Morgan said she was given a football and urged to run between two lines of women holding blocking pads, who attempted to knock the ball out of her arms.

After taking one or two steps, she was hit by one or two women so hard that she was knocked off her feet and hit the back of her head on the training center floor. Her cap and earrings flew off, she alleged. Beck was supervising the drill, Morgan alleged, and it was him who urged the other women to "Hit her!"

Football 101 was a one-day clinic, first organized by former Husker Coach Bill Callahan in 2004, to raise money for breast cancer research. In 2010, it attracted 950 women and raised $125,000. It has not been offered since.

A lawyer representing the Bo Pelini Foundation could not be reached for comment Wednesday.

Morgan's lawsuit seeks $92,564 for medical expenses related to brain surgery and repair of a torn rotator cuff, as well as an unspecified amount for pain and suffering, lost earning capacity, physical impairment and other damages.

this is an unfortunate event that this happened, rather she is telling the complete truth or not, the biggest travesty is the fact that there hasn't been and probably won't be anymore money given to breast cancer research from the charity due to this incident

It's not just women who attend Football 101. Many husbands go to support their wives.

Let's remember this is a breast cancer fundraiser. It's a charity event that doubles as a fun day for Husker fans, but whose primary purpose is to raise money to help support the fight against an insidious disease that affects hundreds of thousands of women.

it being a charity should have little to nothing to do with this case if it was in fact negligent. also (backed to craked, although i am not sure if this is just an awareness charity or actually goes to research. the website was a little vague):

i do agree with this. i think this lesson is the only reason to watch 'the social network'. settlement procedures, when it involves companies with a largess, amounts to nothing more than extortion. basically, 'settle or pay up. pay me or pay the process'. (i coined that, but feel free to use it in any legal educational setting).

 
I was amazed when I read this story. Why is she waiting two years after suffering this injury to file a law suit. Most subdural hematomas are diagnosed within 48 hours of the injury. If this were a serious injury caused by this activity, then the results should've been reported right after it happened. Did this woman experience unconsciousness at the time of her injury? Did she have an MRI done immediately after the injury? Does she have a history of high blood pressure or stroke? But I would assume that participants in these types of activities are required to sign a waiver that says the University will not be held responsible for any injuries incurred during the activity. If there was no waiver signed then I suppose those involved could be 'fair game' but I really don't think the University would be so careless as to have a physical activity like this and not cover themselves legally.

If this woman signed a waiver then she doesn't have a leg to stand on in court. She basically has said in signing that waiver that she is participating in this activity of her own free will. There are too many gaping holes in this story for it to be credible in my opinion. It will be interesting to see how it plays out.

Are you comparing a fundraiser that donates hundreds of thousands of dollars to breast cancer research with an "awareness" campaign?

It's not an awareness campaign. It's not just about wearing a pink ribbon.

 
One of the things that bothers me about this is the fact that she claims that no one from the medical staff helped her after the accident, but yet it took multiple trips to the doctor and two MRI's over a week or two to figure out that she had a brain injury that required imediate surgery. Now if it took these doctors that long to figure this out then how in the heck were the medical staff suppose to figure this out. I just really doubt that no one checked on her. I would also think that they would have known fairly soon after the accident that there was a major problem with her shoulder. A torn rotarcuff is pretty damn painful, but I guess I don't know if it really specifies how soon they realized she had tore up her shoulder.
