I'll bet the media backs Martin and Marlowe on this. Media types get a bit sensitive to encroachments on the 1st amendment.
"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;
or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."
Courts have ruled that it applies to state and local governments as well as federal. It doesn't apply to football conferences, corporations, or message boards.
