The judge was Pilate who released Barrabas (who was guilty) and sentenced Jesus (who was innocent) to die.

 

Jesus's subsequent resurrection is celebrated at Easter with the traditional giving of candies.

An Italian judge released a guilty man and convicted an innocent man and as a result the confectionery industry has greatly benefited. Why?

 

The Italian was Pontius Pilate, who released Barabbas and condemned Jesus Christ to die by crucifixion at Easter time. Every year Easter is marked by the sale of millions of chocolate Easter eggs worldwide.

I thought this was going towards St. Valentine (also martyred by a Roman judge) until I paid more attention to the release of the convicted man in the clue. I also remember hearing some story about biscotti being snuck into prison to feed a wrongfully imprisoned De Medici, but I didn't think it fit the confectioners bit too well.
