Who selects the Supreme Court justices? While the President selects them, the Senate has a "confirmation" process. What's tricky is that some folks think that without Senate confirmation, the applicant can't be named. Not true - the Senate's role is advisory in that case. 18. Who has the power to declare war? Recent events would seem to indicate the President - but it's the Senate. If you'll recall, prior to invading Iraq there had to be a Senate vote. That's what's interesting. Bush declared "Mission Accomplished" years ago. There is a good argument that statement is sufficient for the Senate to vote the war ended.
