@StPaul: Probably not, but since I was never a scholarship athlete, can't say I would know for sure. However, I was referring more to 'normal' students that attend and use them that might make it a federal issue.

I guess my point was, where does it stop? Say I'm a non-athlete getting a partial academic scholarship. Am I now a 'part-time employee' of the University that entitles payment? This is just getting weird.

I'll drop this bomb. What about the frickin walk-ons? Are they left out, since theyre not "paid" with a scholarship?
