Why wouldn't she say..."Sir, I don't have the authority to do that"?

i am confused. i do not understand how obamacare has or is supposed to affect this? it sounds like the decision is being left to the doctors, which is exactly what people feared would be prohibited under obamacare.

Because Obamacare is bad and dying from cystic fibrosis is bad.

She decided against suspending the rules of the policy on the age of somebody receiving an adult lung transplant.

And who said that she had the power to suspend the rules?

And therefore, everyone should ASSUME that this is a statement of fact. Nevermind the fact that there are 3 or 4 other kids are just as sick. Nevermind the fact to 40 adults might die before this kid if they don't get a transplant.

 

Let's have policy makers and politicians pick and choose when to step in and when not to. Right. Great plan.

The stupidity of the parent or the healthcare provider is not the fault of the Health Secretary, nor does it mean "death panels" are now at play. Obviously they did not check every avenue before laying this at the feet of the Health Secretary, and it appears even more likely than ever after reading this that this poor girl's life is secondary to the political points to be gained by dragging her name before the press.

 

And the right-wingers are screaming death panel! all the way. Lovely.

Agree with your post. It seems that one of these high paid congressman/women would have been able to direct the family in that direction. Instead it looks like they are a political football.

  1. Law from circa 1984 (can't reacll who was the President back then) says that OPTN sets the policy and coordinates organ transplants.
  2. Policy is based on very complex criteria and has evolved over time to increase survivability.
  3. Since 2005, the children under 12 haven't been candidates for adult lungs. This rule is based on POLICY created by OPTN (not a 2005 federal law per se, as suggested in the OP).
  4. Never has a Sec of Health and Human Services Sec.over ruled this policy on behalf of a sick child or media savvy parents or a elected politician.
  5. If a child donor lung became available today, the child in question might not be the one to receive it. There might be 3 children with more urgent needs for a child lung.
  6. Because HHS is the key policy making agency under Obamacare and because Obamacare = dealth panels in the eyes of some, the wild assumption is that now the death panels rumor is coming true and this is the first example of how Obamacare will allow the government decide who lives and who dies.
  7. The truth is exactly the opposite of #6. A certain Republican and many right leaning blogs and papers are trying to insist that government bureaucrats, not medical professionals determine which dying child gets a lung and which dying children and adults therefore do not get a lung.

Why do REPUBLICANS like Meehan, Toomey, Price--the ones urging Sebelius-- want a bureaucrat, not a doctor to pick who lives and who dies?
