Disney and Fox have an agreed-upon deal, folks. Let's welcome the Fantastic Four and X-Men (and more importantly, their associated villains) to the Marvel Cinematic Universe...

Fox only owned distribution for Episode IV: A New Hope in perpetuity--everything else Lucasfilm (nee Disney) owns lock, stock, and barrel. And Disney wouldn't go to all the trouble to have Fox take money off the top...just like Disney won't ever release a standalone Incredible Hulk movie because Universal owns distribution rights to that and any standalone films (also why Namor was a no-show in the MCU as well).
But yes, this was a fly in the ointment that was keeping Disney from releasing HD versions of the original, unaltered trilogy. This...and Lucas saying there was no copy of the original Episode IV left in existence...(though one was stitched together by fans in Europe last year, IIRC). Disney doesn't like to share profits on distribution.
