Akron contract The problem is lightning is not a named peril in section 9. Section 10 bolsters that with the "reasons other than those stipulated." One could argue that lightning is implied by the the natural forces named. I'm guessing that's Moos' position. Obviously lightning should have been included, as well as a catch-all phrase like "other natural disasters." Also, the game was called in accordance to NCAA rules. Section 2 gives Akron the upper hand. The NCAA should have been named along with the judicial or governing authority in section 9. The good thing is that this will be adjudicated in Nebraska, we'll have home court advantage...
