Going from my experience and listening to a cop say about 5 times, "I smell fresh cut marijuana, not smoked, but fresh cut," and my friend - Criminal Justice degree - refusing to allow a search of his vehicle, I don't believe smell is PC.

The funniest part of that incodent is the cop must have radioed across the scanner about this scenario because 40 minutes later, after we got home and turned on my roommates police scanner, we hear another cop crack a joke at his expense and ask, "where's that cop with the good sense of smell??"

^^^ That's awesome. After more thought, we don't know the circumstances. Smell doesn't constitute PC. They could've told him to pound sand about a search. But if the report was correct and this was all just laying out in plain sight, how do you NOT prosecute?
