Especially if that minor doesn't have a lot of real adult guidance giving him sound advice on what is right and wrong.

 

Now, I will be sure to tell my son to not keep any pics or videos ever sent to him by a girl and he definitely shouldn't be sending any pics to others.  But, that won't stop him from doing anything stupid.

An interesting piece of this case is that there was police (court?) order for everyone that had that video to delete it. Part of the prosecution and why CA is prosecuting is whether Mo knew that he was supposed to delete that video. I have no idea of any of that, but your post reminded me of that detail.

There isn't even a decision to prosecute at this point. He's been charged, but these proceedings that keep getting delayed are simply so both sides can review evidence. After that, the prosecution may happen. Or it may be dropped. Or he may plea it down. Hard to say.

If we want to assume he didn't keep it on his phone the whole time, that means he had to have re-received it from someone that didn't delete it by police order, then send it to the girl?  When he should have either deleted it immediately or reported it to police?  I'm not sure that paints him in a better light.

What if he's texting this girl, tells an old school pal that they're talking, that person sends Mo the video, and he then sends it to her with the caustic remarks?

 

There are SO MANY possibilities in this scenario that all of these presumptions are just spinning tires. The ONLY thing we know is he sent her the video.

Maybe there's some legal nuance to "prosecuting" that I'm unaware of, but the state has brought charges against Mo and continues to pursue them, which is what I mean.

I'm not saying it makes it any better or worse. 

 

I'm just saying that you always like to talk in such absolutes and throw out accusations when you're making as many assumptions as anyone.

I agree. I'm just asking if it's any better under any of those possibilities. That he sent the video is what I think he deserves punishment for doing by the university.

Has anyone heard if this old school pal, or anyone else for that matter, was brought up on the distribution of child porn charges related to this case?  Because I think that would be a pretty significant piece of the puzzle.
