Akron AD is experiencing a severe case of Butt Hurt:

 

"We showed up, we kicked off, we played,'' Akron AD Larry Williams said Thursday night.

Since then, Nebraska has shied away from paying Akron the $1.17-million due from the contract.

 

"That's all in the hands of the lawyers now,'' Williams said.

He was planning on using that one game to fund the Akron athletic budget this year.  Now they may not be able to cover Bowden's salary.  :D

 

If Nebraska covered their travel expenses and paid Bowden's salary for the year, they would still save ~$800,000 of the $1.17 million and likely cover the payout to the other team scheduled.  Give Akron $250,000 and they may end up with a game and some extra money left over.

He is right, it is in the hands of the lawyers.  Should have played on Sunday.  I have heard some whining around here.

No. You didn’t play. The reason Nebraska paid you was to play the game. They shouldn’t have to pay when you didn’t give them a win or a loss. They paid for everything Akron did.

Yea the goofball copied wording from Miami contracts that describes weather in south Florida. The wording was posted here and my first thought was Akron’s lawyers are going to love it. Notice their AD didn’t mention anything about the weather because there isn’t anything in the contract about thunderstorms. They fulfilled the contract (as written) and will probably get paid.

The problem is lightning is not a named peril in section 9. Section 10 bolsters that with the "reasons other than those stipulated." One could argue that lightning is implied by the the natural forces named. I'm guessing that's Moos' position. Obviously lightning should have been included, as well as a catch-all phrase like "other natural disasters."

Also, the game was called in accordance to NCAA rules. Section 2 gives Akron the upper hand. The NCAA should have been named along with the judicial or governing authority in section 9.

The good thing is that this will be adjudicated in Nebraska, we'll have home court advantage...
