Former Trump White House senior adviser Stephen Miller on Wednesday filed a civil suit against the House Jan. 6 select committee in an attempt to block subpoenas of his phone records.

Driving the news: "The Subpoena is overly broad and seeks information that is unrelated to the purposes whereby Congress established the Select Committee," according to court filings out Wednesday.

  • "Moreover, the Subpoena violates Mr. Miller's protections under the First and Fourth Amendments to the United States Constitution, as well as federal law."
  • The suit also argues that the phone records contain "sensitive, personal communications" between Miller, health professionals and family about his wife and new-born daughter.
  • The House Select Committee did not immediately respond to Axios' request for comment.

What they're saying: "[Miller] takes no issue with the Committee's investigation of the attack on the Capitol, as well as the circumstances surrounding that disturbing event," per the court filings.

  • "However, there are no facts that show that Mr. Miller had any role in what happened there or otherwise engaged in any unlawful efforts to interfere with the peaceful transfer of power to the Biden administration."

The big picture: Miller was subpoenaed last year by the House committee with nine other former senior Trump administration officials.

  • The committee said the former Trump adviser helped spread false information about alleged voter fraud in the 2020 election and encouraged state legislatures to alter the outcome of the election, Axios' Sophia Cai reports.

Former U.S. Army Prosecutor Glenn Kirschner concluded that former President Donald Trump "will be charged" in connection with the January 6, 2021, riot at the U.S. Capitol and the effort to overturn the 2020 election results after new remarks from Attorney General Merrick Garland.

In an interview with NPR that aired on Thursday, Garland said "everyone" who committed crimes related to January 6 would face accountability.

"We begin with the cases that are right in front of us with the overt actions and then we build from there," the attorney general said. "And that is a process that we will continue to build until we hold everyone accountable who committed criminal acts with respect to January 6."

Hundreds of Trump's supporters stormed the Capitol after the then-president at a nearby rally urged them to march to the federal legislative building and to "fight like hell." More than 780 of Trump's supporters have been indicted for their actions that day, with some saying in court that they believed they were carrying out Trump's orders.

What's the Trumpists excuse going to be for this?  "Mo Brooks is lying"? Mo Brooks was always Deep State"?  Or "Well he said it but didn't really mean what he said"?  

 

At this point those who still support Trump, support a fascist takeover of our democracy.  See Russia and Putin's destruction of not only of the Ukraine but of his own country to see our future if this menace ever again regains power.  It won't be pretty.

Long but insightful article on the role Cruz played in trying to get the election nullified.  In reading the article one can easily see that Cruz does nothing but for political expediency.  He is an opportunist on the same level as Trump and would be the same type of person who who place person gain over country if he ever made it to the White House - which is his goal as reflected in the last paragraph.  The House Jan 6 committee needs to get Cruz on the hot seat and testify about his involvement.
